Acceptable Use Policy – IGS Hawkesbury

Introduction

IGS Hawkesbury Inc. ("IGS Hawkesbury") is committed to being a responsible and ethical participant on the web. This means we aim to contribute to the usefulness, functionality, and overall enjoyment of the Internet. To achieve this goal, we require all individuals using our services, equipment, and website (as defined in IGS Hawkesbury's "Terms of Service") to adhere to this Acceptable Use Policy ("AUP").

Terms that are defined in the Terms of Service and used in this AUP without further definition shall have the same meaning as in the Terms of Service. For clarity:

  • "I," "me," "you," "your," and "yours" refer to you and any individuals you authorize to use the service or act on your behalf regarding the service;
  • "We," "our," and "us" refer to IGS Hawkesbury.

If you do not agree to be bound by this AUP, as amended from time to time, you must immediately stop using the services, equipment, and website, and notify IGS Hawkesbury to cancel your services in accordance with the Terms of Service and any applicable service agreements.

Prohibited Activities

When using the services, equipment, or website, you are prohibited from using, enabling, facilitating, or permitting the use of these for the following purposes, and from assisting anyone in doing so:

a) Any use or purpose that violates applicable laws and regulations.

b) Any illegal or criminal purposes, including but not limited to activities related to harassment (whether criminal or not), child pornography, obscenity, making threats, hate speech, fraud, hacking, unauthorized use of a computer, or data mischief.

c) Any use or purpose that leads to civil liability or violates the rights of IGS Hawkesbury or any third party, including but not limited to copyright infringement, trademark infringement, patent infringement, misappropriation of trade secrets, or defamation.

d) Intrusion into, violation, or breach of the privacy of other internet users.

e) Any comments or actions constituting harassment or abuse, whether verbal, written, or otherwise, towards our employees, suppliers, agents, representatives, or any internet user or group of users.

f) Any use or purpose aimed at restricting or preventing any other internet user from using or enjoying the internet.

g) Impersonating other IGS Hawkesbury subscribers or engaging in fraudulent activities, including but not limited to forging anyone’s digital or handwritten signature.

h) Reproducing, distributing, selling, reselling, or otherwise exploiting the services or content provided by us or obtained through our services for commercial purposes, without our explicit written consent.

i) Copying, distributing, sublicensing, or otherwise making available any software or content provided by us or obtained through our services, except with our authorization.

j) Transmitting content, including but not limited to unsolicited messages (i.e. spam), which, in our opinion, causes interference or disruption to IGS Hawkesbury’s network, the internet, or the use or enjoyment of the internet by other users, whether intentional or not.

k) Any use or purpose aimed at disrupting or attempting to disrupt computer networks, telecommunications systems, or services to or from any user, host, server, or network, including but not limited to compromising security, tampering with system resources or accounts, carrying out denial-of-service attacks, overwhelming a service, misusing operator privileges (hacking), attempting to crash a host, disrupting user sessions, or excessively consuming CPU time, memory space, or hard drive storage.

l) Any use aimed at consuming excessive amounts of bandwidth or using bandwidth in a way that disrupts computer networks, telecommunications systems, or services to or from any user, host, server, or network.

m) Any use aimed at accessing or attempting to access any internet host, computer, software, or data belonging to another person without their authorization, or using tools designed to facilitate such access, like "packet sniffers."

n) The transmission, display, publication, distribution, reception, retrieval, storage, reproduction, or distribution of any file, program, or information (including but not limited to sniffing programs, hacking tools, or network exploration tools) designed to help users compromise the security of the service, IGS Hawkesbury’s network, or telecommunications services, or accessing such files, programs, or information.

o) The transmission, display, publication, distribution, reception, retrieval, storage, reproduction, distribution, or access to any harmful or disruptive file, program, or information (including but not limited to viruses, cancelbots, Trojan horses, and worms), even if the intent is to test or analyze host security mechanisms.

p) Any use aimed at attempting to obtain services without paying applicable fees.

q) Modifying or disassembling the services or equipment.

r) Any use aimed at changing any identifier issued by IGS Hawkesbury without their consent, or falsifying or manipulating identifiers for malicious or inappropriate purposes or with the intent to conceal the origin of any content transmitted through the services.

s) Any use aimed at exploiting an internet host’s resources in a manner not authorized by its administrators, including email relaying, transmitting chain letters, get-rich-quick schemes, or any kind of pyramid scheme.

t) Any use aimed at operating a server in connection with the services, including but not limited to email, news, file, Gopher, Telnet, chat, host configuration servers, streaming platforms, or multi-user interactive forums, unless you have purchased services specifically designed to support such functionalities and are authorized to do so.

General Terms

How can IGS Hawkesbury respond to violations of the AUP?

In accordance with the Terms of Service, IGS Hawkesbury may restrict, block, suspend, disconnect, or terminate any service or agreement for a valid reason if the AUP is violated. IGS Hawkesbury may also take any other necessary action to address a violation of the AUP within the limits of the law, including but not limited to the temporary or permanent removal of content, cancellation of messages posted in discussion groups, and filtering internet transmissions.

IGS Hawkesbury will evaluate the circumstances leading to the violation before making any such decision.

Will IGS Hawkesbury modify the AUP?

We may modify this AUP at any time by posting a notice of the changes on the website. The modifications will take effect on the date the updated policies are posted on the website.

Which laws govern the AUP?

The AUP is governed solely by the laws of the province or territory where your billing address is located and is interpreted in accordance with those laws. However, if your billing address is outside of Canada, the agreement is governed solely by the laws of the province or territory where the services are provided.
